Can buyers assign contracts on 30A, and should I allow it as a seller?

June 12, 2026
Yes, buyers can assign contracts on 30A if the purchase agreement allows it. An assignment lets the original buyer transfer their rights under the contract to another party before closing.

As a seller, you should approach assignments carefully. The biggest risk is ending up with a different buyer than the one you originally approved, which can create uncertainty around financing, timelines, and closing.

That said, assignments are not always a red flag. Many luxury buyers use LLCs or trusts for ownership purposes, and an assignment may simply be part of their purchasing strategy.

According to Myles Jones, the key is determining whether an assignment increases or decreases your certainty of closing. In many cases, sellers are best served by requiring written approval before any assignment can occur, allowing them to review the new buyer’s qualifications and maintain control of the transaction.

For most 30A sellers, allowing assignments only with prior written consent provides the right balance of flexibility and protection.
